Terms of Service

Welcome to BeatTube. These Terms of Service (“Terms”) govern your access to and use of the BeatTube website, applications, and services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. What the Service does

BeatTube helps music artists and producers discover instrumentals (“beats”) published on YouTube, preview them, analyze musical attributes such as tempo (BPM) and key, and — where you have the necessary rights — obtain audio files for your own use. The Service uses YouTube API Services; by using BeatTube you also agree to be bound by the YouTube Terms of Service.

2. Your responsibility for content rights

The beats surfaced by the Service belong to their respective creators. BeatTube does not grant you any license to any beat. You may only download, store, or use audio through the Service if at least one of the following applies:

• you are the copyright owner of the recording;
• you have an explicit license or written permission from the copyright owner;
• the creator has made the work available under terms that permit your use (for example, a “free download” license), and you comply with those terms — including credit and non-commercial restrictions where they apply.

Every download requires you to confirm you hold such rights. You are solely responsible for that confirmation being true. Misuse of the Service to infringe copyright may result in suspension or termination of your account (see Section 8) and may expose you to legal liability.

3. Accounts

Some features require a BeatTube account. You must provide accurate information, keep your credentials secure, and be at least 13 years old (or the minimum age of digital consent in your country). You are responsible for all activity under your account. You can delete your account at any time from the account settings page.

4. Plans, subscriptions, and billing

• Free tiers. Guest and free-account usage is subject to daily download limits, which we may adjust to keep the Service sustainable.
• Pro subscription. Pro is a paid monthly subscription billed through our payment processor, Stripe. Prices are shown at checkout and may change with reasonable advance notice; changes apply from your next billing cycle.
• Cancellation. You can cancel anytime via “Manage subscription” on your Plan page. Cancellation stops future renewals; Pro remains active until the end of the period already paid.
• Refunds. Except where required by law, payments are non-refundable. If you believe you were charged in error, contact us at tony005529@gmail.com.
• Fair use. Pro is subject to a fair-use cap (currently 100 downloads per day) to prevent abuse.
• Invite codes. Invite codes grant Pro features free of charge. They are discretionary, non-transferable unless we say otherwise, and may be revoked in cases of abuse.

5. Acceptable use

You agree not to:

• use the Service to infringe any third party’s intellectual property rights;
• circumvent, disable, or interfere with rate limits, download quotas, authentication, or any other security or access-control measure;
• access the Service with automated tools (bots, scrapers) or resell it;
• share one account across multiple people to evade plan limits;
• use the Service in violation of applicable law.

6. Intellectual property

The Service — including its software, design, and branding — is owned by BeatTube or its licensors and is protected by intellectual-property laws. These Terms do not grant you any rights in the Service except the limited right to use it as intended. All beats, artwork, channel names, and other third-party content remain the property of their respective owners. BeatTube is not affiliated with or endorsed by YouTube or Google.

7. Copyright complaints

We respond to copyright notices as described in our DMCA Policy. We terminate the accounts of repeat infringers.

8. Suspension and termination

We may suspend or terminate your access (including cancelling subscriptions prospectively) if you materially breach these Terms, if required by law, or if the Service is discontinued. You may stop using the Service at any time.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. DETECTED BPM/KEY VALUES ARE ESTIMATES. WE DO NOT WARRANT THAT ANY BEAT IS AVAILABLE FOR YOUR INTENDED USE — VERIFYING RIGHTS IS YOUR RESPONSIBILITY.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BEATTUBE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE (OR USD $10 IF YOU HAVE PAID NOTHING).

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced on the Service or by email before they take effect. Continuing to use the Service after changes take effect constitutes acceptance.
